Base sa resolution, meron nang kasong rape through sexual assault na isinampa laban sa dalawang independent contractors sa Department of Justice (DOJ) kaya "overkill" na itong kasong acts of lasciviousness.
hindi naman dismissed ang kaso, yung isa lang kasi redundant na. Meaning nagfile na ng matinding kaso so no need for the second case kaya dismissed based on technicality.
Normal process naman yan pag may multiple cases.. tinatanggal ung mga case na redundant or mahina ang evidence. Tinitira ung feeling ng judges ay valid at dapat itrial..
sa MTC lang itong nadismissed, up to 6 months na kulong lang penalty. pero yung RAPE charge ang hinhintay na resolution sa DOJ, kapag yun ang umakyat sa korte mas matagal na kulong ang parusa at usually no recommended bail pa, kaya abang abang lang
Sayang ang parusa for that. Dapat i-add sa parusa sa case na rape. Para mas mahaba ang sistensya.

ReplyDeleteWith all the DNA testing, if there was indeed penetration that happened, they can easily swipe his backdoor to check for the DNA of the 2 culprits..
