Cyberlibel - while the "panloloko" might be true, there is still the DEFAMATION dimension (1st requisite of cyberliber) which was aimed to to impeach the honesty, virtue or reputation or to hold the person or persons up to public ridicule. As to MALICE - when the offended party is a PUBLIC figure, there is a stricter standard of "malice" but it does not mean absence of actual malice.

I dont condone cheating but what this Jam person did wasn't any better and it triggered a wave of bullying, slut shaming and made a series of incidents that are supposedly private for the whole world to feast on. She could've just settled it privately by confronting her ex and Maris and asked Maris to talk to her fans and lay off and stop the bullying. It brought out the worst in a lot of people na karamihan wala namang kinalaman sa situation and incited a mob. Her truth? ReplyDeleteI know J is hurting. It's understandable that she wants to get some kind of revenge. But under Philippine law, sharing screenshots of private sexual or privately sensitive text messages without the consent of the 2 individuals involved can lead to legal consequences. Several laws address the unauthorized disclosure of private communications:
1. Data Privacy Act of 2012 (Republic Act No. 10173): This act protects personal information and requires consent of both parties (M and A) for its processing and disclosure. Sharing private conversations without consent may be considered unauthorized processing of personal data. Violations can result in penalties, including imprisonment and fines.
2. Anti-Photo and Video Voyeurism Act of 2009 (Republic Act No. 9995): This law penalizes the unauthorized recording, reproduction, and distribution of sexual content without the subject's consent. While it primarily addresses visual content, its principles may extend to the unauthorized sharing of sexual text messages.
3. Cybercrime Prevention Act of 2012 (Republic Act No. 10175): This act criminalizes offenses such as illegal access, data interference, and cyber libel. Unauthorized sharing of private messages can be construed as a cybercrime, leading to penalties under this law.
4. Revised Penal Code – Crimes Against Honor: The Revised Penal Code penalizes acts that cause dishonor, discredit, or contempt to a person. Sharing private sexual messages without consent can be considered an act that damages a person's honor or reputation, leading to potential criminal liability

DeleteCyberlibel - while the "panloloko" might be true, there is still the DEFAMATION dimension (1st requisite of cyberliber) which was aimed to to impeach the honesty, virtue or reputation or to hold the person or persons up to public ridicule.
As to MALICE - when the offended party is a PUBLIC figure, there is a stricter standard of "malice" but it does not mean absence of actual malice.
RA10173 defines SENSITIVE PERSONAL INFORMATION as personal information "about an individual’s health, education, genetic or sexual life of a person...".

ReplyDeleteThere’s something wrong with the laws then if the morally wrong is perfectly legal, and Maris and Anthony are painted as the victims in this situation. Why is the privacy of cheaters protected while they’re cheating? The law should not be protecting that.
ReplyDeleteAnd dapat walang papasang libel case if the person is telling the truth. Libel should be first and foremost false. Halata naman talaga mga prinoprotektahan ng batas where the truth has little or no bearing on libel cases. Kaya walang sumseryoso sa batas Pilipinas. Imbis na protektahan mga nagsasabi ng katotohanan, sila pa kinakasuhan.
Nakakahiya na nga nangyari, magpapa victim pa sila Maris? Tahimik na lang sila. They can still redeem themselves in time, learn from this experience and be better. Lahat tayo nagkakamali at tao lang din sila. Pero pls lang, wag sila pa victim. May resibo ang nangyari. Hahaha

Additionally, they need to focus on saving money because they may not be able to get more contracts. Furthermore, what return is there for suing? Everything in that text exchange was true. Their image won't magically be clean.
