ReplyDeleteIn the case of People of the Phils versus Rodriguez, Rodriguez committed the crime of human trafficking, and so the Court decided that screenshots and recording of private messages or communication to be used as evidence for the commission of a crime will not violate data privacy law, iba naman yung kina Maris, because Jam intentionally published the screenshot for everyone to see. It's not used as an evidence in court, there was an intent on her part to humiliate Maris and Anthony by exposing their private messages.

While privacy laws are essential, they should not be weaponized to invalidate a victim's response to the betrayal and public bullying that led to Jam exposing the private conversation. Jam is already known by many as the live-in partner of the guy. Sa social construct, 7 years may already deem her as the common-law partner. Jam used the screenshots to substantiate her claims and defend herself after being vilified, a morally defensible action given the context of her emotional distress. ReplyDeleteSa isip-isip ko din as I read back again the SS of Ex gf of the ex bf's private convo with the third party and was posted by her on socmed was actually intended to counter ex bf's interview about the status of their relationship. The SS post doesn't intend to ruin someone's reputation, but to counter the ex bf's claims, which were all false claims according to the ex gf kaya na provoke mag post si atih. Only the bashers' and fans' reactions identified the third party, they're the ones who actually pointed fingers on who the third party girl was, then it went viral targeting the third party girl. Mga marites at sawsawera ang nag confirm kung sino si ka convo ni ex bf. That's my thought on this.

What avenue or PR Team does a private citizen have when rabid fans of a celebrity endlessly attacks them? It would be different if the fans and management of said celebrity took actions to address the bullying of a private citizen resulting from the fans of the said celebrity, but that was not the case. For months and months, Jam, who is a private citizen, was subjected to character assassination by M's fans and she also had no avenue to express her feelings because M's fans are attacking her. What other method is there for a private citizen to protect themselves against a celebrity with all these known resources?

She might have stumbled upon these text exchange, seeing as she's living in with A, and then upon seeing it, took screenshots of it because when you're cheated on and are in shock, you are likely to do that. Now, she knew about the cheating way before the exposing of these text messages. She did not expose it. But, months later, she did and it was because, unlike celebrities (who chose to be public entities and have PR Teams) she's a private citizen being bullied and bombarded by M's rabid fans, like you. Kung mag lawyer rin si Jam, it could be argued that the act does not constitute cyberlibel but falls under "fair comment or qualified privilege".
Jam needed to protect herself as a result of character assassination from the fans of M. If there was an intent of malice, she should have exposed everything way earlier. But, as we know, she only exposed everything after months of bullying from M's rabid fans; which M and her management (who are very public group), never tried to address.

ReplyDeleteThey have to prove that there was malicious intent. 1) Jam was living in with A and could have stumbled upon the text exchanges (as such no interception) 2) Jam is not earning any money from exposing the text messages and is not blackmailing any party 3) she exposed the text messages for self defense (especially if she has countless text messages / chat messages from M's rabid fans threatening her). Furthermore, there was no wording or statements on Jam's end that was directly vilifying the other person. Jam has a legitimate protection.
