    2. 1:16 That's only applicable if there's a positive act on the part of the offended party like filing a case, then, there's a non-action on the part of the court or the defense tries to delay the proceeding. In this case, wala namang ginawa ang side ni gerald dahil hindi naman sila nagfile ng case, thus, there's no denial of justice.

    1. Dapat lang. Constitutional right naman talaga yan na innocent until proven guilty. kung ang presumption ay guilty until proven innocent marami ang makukulong na walang kasalanan. Sa criminal case pa naman beyond reasonable doubt. Mas ma appreciate mo yang principle na yan kung ikaw ang inakusahan ng mga inggit or may galit sayo. Laws were enacted not to persecute.

    5. I have to agree with 2:31. The burden of proving the act of rape (or any accusations of wrongdoing) indeed happened falls on the victim. So all evidences are crucial. Kaya nga masaklap na hindi sila ginabayan ng GMA sa kung anong dapat gawin nung time na naireport sakanila yung rape.

Kaya nasa biktima ang burden na patunayan ay para hindi gamitin ang batas para manira ng tao. Marami nang gumawa ng ganyan, gagawa ng kwento para lang nanira ng puri o maghiganti. Sinasabi ko lang na agree ako sa unang nagcomment kasi proteksyon din yang “burden” na yan sa lahat. Sana hindi ka rin kasuhan sa isang bagay na hindi mo ginawa kasi baka sakaling mas maintindihan mo yung sinasabi ko.

    1. I think ibang usapan naman yun. Sige, granted na they'd give him work ulit, tingin mo ba magkakaroon ng outpour ng fan support which will sustain his career for years? I don't think even the hardcore haters of GMA would support him that way just to spite the network. Sad truth is, marunong siyang kumanta and I do find him cute (that's my personal preference), pero hindi niya na kakayaning makipagsabayan sa current crop of performers. The only thing he's got going on for him now is this issue. And I do pray he gets the justice he deserves.

  9. He was a minor when that alleged assault happened, however,he was already at a majority age when he brought up the complaint to the management. He had the freedom and intelligence to decide what to do with his case. Employers don't have the authority to penalize their employees beyond suspension or dismissal from service. You are also his manager. As his guardian, why didn't you advise him of the possible steps that he could take. There's no provision in the rules of court that prior recourse to the employer is a condition sine qua non for the filing of a criminal case. You don't even need a private lawyer in a criminal case since it is the prosecutor who will represent the state and your client in court. Why blame everyrhing on gma? You, as his guardian, and his parents failed him big time. Obvious na masyado ang rason kung bakit nag iingay. Naiintindihan ko kung ginagawa ni gerald yan for justice pero tingnan nyo ginagawa nila naka focus sila network kaysa habulin ang pagkaso sa musical director bago mag prescribe ang crime. Hanggang ngayon wala silang ginagawa. Puro pag iingay lang. Ano ba talaga gusto mo? Makuling ang alleged perpetrator na yun or umingay ang name para magkaproject? Ang weird lang ng approach na ginagawa nila gerald kung ang habol nila ay hustisya at putulin kung ano man ang abuses na ginagawa at magagawa ng pinagbibingtangan nya. Remember, innocent until proven guilty.

    1. Gerald was a minor that time and his family was not really well off. Though the company may not be responsible to any additional steps after firing the director, they should've coordinated with them yung action na ginawa nila. If yun lang yung kaya nilang gawin e di so be it. Second, they should've honored his contract. After he raised the issue, nawalan na sya ng work which led him to find another network. Kung di rin malakas kapit ng manager mo sa industry, I doubt may enough power sya to call these out. Lastly, as an employer, they should also extend help beyond firing the perpetuator dahil the incident happened at work. If not legally at ayaw nila madamay, tama nga naman na kahit to ensure na ok pa rin sya mentally, emotionally, kasi nga minor sya. May mga rules naman siguro about employee welfare and child labor. And if wala pa ngang established na labor laws at mga ganyang stipulation sa contracts ng celebrities to ensure na hindi sila maeexploit in any way, thus this senate hearing. Kaya dinidinig yung cases. Yung legal help na gusto ni Gerald, labas na yan dito e. May senate hearing kasi they need to see kung ano bang kulang at mali sa current labor laws natin at nakakalusot ang ganito. And kapag ganun na nga, employers na yung titingnan. Aside from the usual na prinoprovide ng employers, ano ang ginagawa nila to ensure na napprevent ang criminal activities lalo na kung umaabot pala sa kanila ang ibang complains. You can even be charged as an accessory to the crime if you were the employer, you were informed of these cases inside the workplace and you did not do anything about it.
      Kaya lang naman parang circus yang hearing kasi sa mga senator na kasali. If someone who knows the law is presiding that, siguro malinaw na sa lahat by now bakit may senate hearing at ano ang pwedeng pananagutan ng GMA as an employer.

Now gusto mag ingay. Diko rin ma gets nag resign sa artist center pero gusto under GMA pa rin, e lumipat na nga cya sa TV5. His story's all tangled up, meantime nakikibandwagon mga tao sa sympatiya.

  10. Totally agree with Rommel. Since GS was a contract artist then, and still a minor, the network could have given him all the support to survive a very traumatic incident. But since the network wants to protect their image, they just discreetly terminated the perpetrator and must’ve declared a news blackout.

    Imagine yourself sexually abused in the workplace at 15. Para walang gulo o ingay, terminate nila yung umabuso sa yo and case closed. Bahala ka na sa buhay mo. Magdemanda ka kung gusto mo pero walang support sa management kasi laban mo yan. All these at 15.

    tv5 pa nga thru MVP himself is to going to extend medical assistance such as therapy to an employee who recently went thru the same circumstances similar to Gerald's, besides firing the alleged s*x*al predator.
    Kinapos talaga ang gma sa ginawa nilang pagtugon sa problema.

  14. Nasa batas naman talaga na kung sino ang nag aakusa, sya ang magpapatunay. That burden of proof never shifts. Beyond reasonable doubt. Hanngat walang sinasabi ang korte na guilty ang MD na yun, mananatili syang inosente at si gerald ay mananatiling nag aakusa. Magkaso ka kasi hindi naman magastos yan. Since against the state, Office of the Prosecutor ang maghahandle nyan. Ano pa ba ang hinihintay no gerald? Malapit ng mag abutan ng prescription tapos nganga pa rin sya.

  22. Kung may dapat sisihin diyan yung manager. Alam na niyang ni-rape yung alaga niyang minor hindi agad siya nagsampa ng reklamo sa pulisya.
    Nagpa-release sa GMA dahil lilipat sa Channel 5 tapos nung hindi nagtagal doon gusto nila uli bumalik sa GMA.

    3. Kase ante need nya ng help ng company kung san sila pareho employed. Ang rinereklamo nya ay kapwa employee nya. Since under sila ng company, liable ang GMA dahil may contract sha sakanila and at the same time, yung alleged perpetrator, employed din ng company. Pwede din naman sha dumerecho sa pulis pero hihingan ka ng statement from the company na aware sila sa nangyari etc. Di sha ganyn kadali pero mas mapapadali kung cooperative ang company

  27. GMA can’t do anything kasi di sila ang biktima. Ang pagkakaso nang sexual abuse and rape ay nasa biktima. Sila dapat ang nagkaso sa pulis at nagconsult sa lawyers. Hindi kasi GMA ang naging biktima nang SA, pano nila kakasuhan ung dating empleyado?

    3. Tulad ko, hinarass ako ng Supervisor ko nun sa work. Nagsumbong ako sa management, ayun tinanggal sya sya sa trabaho. Masaya na ako dun parang nakaganti na rin ako. Nasa sa akin na un kung idedemanda ko pa sya pero di ko na ginawa dahil mas gusto ko na lng mag-move on.. Nagresign na lng din ako sa work para makatulong sa pagmo-move on.

Imagine you own a small business you have a tindera who works for you one day this person came to you to say she was abused by one of your suppliers but you cant afford a lawyer since it is a small business kunyari maliit na grocery lang or siguro sari sari store I think it is your responsibility na kahit paano samahan mo sya sa baranggay or sa pulis or sa PAO para makakuha ng tamang advise or if minor sa dswd. Eh GMA yan imposible naman wala silang budget sa ganyan.

Ngayon kse naka focus pa kayo sa GMA which is mahihirapan kayo ipanalo I think. Until now di pa kayo nagsasampa kaso dun sa director at di pa napapangalanan. Since alam na naman ng public nangyari sa inyo oras para kumilos kayo at hwag ng atupagin ang social media at idemanda na yung director na yan.

  34. Buti pa ang TV5 naaksyunan na ung complaint nung baguhang talent nila. Si MVP pa mismo ang nagupdate kay Tulfo. Bilis ng internal investigation. Binigyan ng results and findings ang complainant na magagamit nya din for when he files a criminal complaint. Meanwhile, ang GMA busy sa pagdidistansya. Nadala na sa Senado, pagdidistansya pa rin ang approach. May post pang nalalaman si A Gozon na parang patama kay G. Kung ginawa sana nila ung ginawa ng TV5 ngayon edi sana nakapagfile din ng criminal complaint before si G. His case would have been even stronger then lalo't the incident happened when he was still a minor. A billionaire network opting to trample on a small talent instead of offering assistance is just so low. Ang cheap ng moves.

    1. 7:04 hindi ako faney pero yung investigation sana ng GMA will helped Gerald’s case kapag nagsampa na sya ng kaso pero wala nmang ginawa ang GMA. Kung pupunta ka sa pulis malamang maghahanap yan ng documents from your company kasi the abuser and the victim were both GMA’s employees. Hello, HR WORK YAN.

  37. Umalis si Gerald sa GMA artist center after complaining against the alleged perpetrator. Tapos ikaw na nag manage sa kanya....dapat ikaw ang tumulong mag file as his manager.
    The incident also happened in 2005 in Iloilo in a mall event of a brand (it was not a GMA event). Hindi GMA ang manager ni Gerald at that time. Hindi din alam ng GMA na pupunta si Gerald doon. Sino ba manager nya noon? Bakit wala din ginawa?

  43. Sino ba kasi kinakalaban ni gerald ngaun? Gma ba or ung ung perp? Kasi kung inalis na ng gma ung perp sa network hindi ba dapat siya mismo magfile ng case kung gusto niya makulong yung tao? Nagawa na ni gma ung part nila na alisin sa network pero bat nagiingay siya? Bat hindi siya magfile ng case sa court at habulin niua ung tao mismo hindi yung network? D ko lang gets kung ano pinaglalaban niya at sino gusto niya kalabanin, don't get me wrong na wala kong sympathy sknya hindi ko lang gets talaga kung ano gusto niya mangyari pa.

Fact: Nagsumbong si Gerard sa GMA 5 years pagkatapos mangyari yung alleged sexual harassment ( ito yung laman ng complaint) sa kanya ng isang musical director. 19 years old na siya noon. Fact: Tinanggal yung musical director ng GMA. Fact: Nagpa-release sa management contract si Gerard Santos sa GMA artist center o GMA. PERCEPTION ( o batay sa opinion ): Sa tingin ni Gerard, kaya wala siyang proyekto, pinag-initan siya ng mga kaibigan nung musical director. Wala siyang pruweba dito. PERCEPTION: Kulang yung ginawa ng GMA sa pagtanggal sa musical director.

Gerard's original complaint against the musical director was about sexual harassment- he said in one of his interviews that he was groped and there was an attempt to molest him but the abuser did not succeed. Tama langna tanggalin yung director sa ganyang allegations. Gerard said that he was raped only at the Senate hearing.

    1. @6:57PM Sadly, it seems walang legal guidance si GS noong bata pa siya. Di niya alam which term to use: harassment, abuse, assault, rape, etc. Kung may attempt talaga like his shorts was pulled down and his genitalia fondled, he must've termed it as harassment or assault, kasi di naman natuloy. Di po ako lawyer, just sharing my thoughts. :)

      Eh ano bang malay ng kinse anyos na gustong kumita ng pera? Marami nga sa atin, baka naglalaro pa or busy sa crushes noong 15 tayo. Mapalad pa rin tayo.

  48. so many here doesn't know the 2 sides and puro dada. Gerard asked for an early release from the network and transferred to tv5 at the start of the investigation. It means GMA has no responsibility or whatsoever to him anymore like consulting a psychiatrist etc. It was his choice.Look at his statements from all his interviews especially with Butch Francesco, it's so different from what he is saying now.

  50. Kung meron man dapat sisihin sa nangyari kay Gerald ay yung manager niya noong 2005, year kung saan siya "na-rape" dahil 2006 nung i-manage ng GMA si Gerald.
    Nag-file ng complain si Gerald 2010, the same year na nagpa-release siya sa GMA para lumupat ng Channel 5. Please read between the lines.

  51. The incident happened in 2005, when Gerald was still NOT part of GMAAC. He won contest in 2006 and only then signed up with artist center. When he complained in 2010, GMA fired the accused. Gerald said he was harassed. Kung sinabi agad nya tug at he was allegedly raped, eh di sana mas mabigat action. Kase sa senate lang naging rape ang claim nya eh. Ano bang justice gusto nila? Why not file for case themselves? GUSTO NILA, gma file for thsm?
