    1. They got married in the US before their wedding in the Philippines ata

    2. Tom is US citizen. Since may divorce sa kanila sa US, inacknowledge dito.

      Delete
    3. Sa America nag file si Tom dahil American citizen siya. Kahit sa America nag file valid din sa Pilipinas ang divorce nila

      Delete
    4. But the Philippines does not honor the US divorce especially since they’re married here too. Under Philippine law, they’re still married until that marriage is annulled. Study the law before you guys comment.

    6. 1:38 marami akong kakilala dito ikinasal Pero nagfile ng Divorce s US, as long as magpasa ng papers s LCR ng para s Cenomar. Simple process lang sya Pero kelangan aprubado na May Cenomar kayo

    8. 1:38 am ikaw dpat mag aral. US citizen si Tom kaya khit san pa sila kinasal, ihhonor ung divorce. Unless both of them are Filipinos, even if they get married abroad, they will still be under Philippine lae. Gets mo na?

      Delete
    9. 1:38, acceptable sa Philippines ang divorce na galing sa US dahil US citizen si Tom.

      Delete
    10. pede ka mag apply ng divorce sa ibang bansa na may divorce. when it is approved, magfafile ng acknowlegement sa Pilipinas.

This is what happened to my brother, his ex wife applied for divorce sa US.

This is happening din sa mga Pinoy/Pinay na nagpupunta ng Canada and nakakahanap ng iba.

      Delete
    11. 1:38 Tama naman si 11:28, since US citizen si Tom i acknowledge un divorce sa Pilipinas, pero if parehas sila FIlipino Citizen at nagdivorce sila abroad hindi iacknowledge sa Pilipinas un divorce. Study the correct law.

      Delete
    12. 1:38 Naku naman Inday gigil mo ko. May audacity ka pang magsabi ng study the law before comment.

There is no divorce in the Philippines, but when a divorce is validly obtained abroad and initiated by the foreign spouse, the Filipino spouse shall have the capacity to remarry under Philippine law.

iGoogle mo na lang yang sinabi ko para maliwanagan ang malabo mong pagiisip.

      Delete
    13. 1:38 narecognize na nga under foreign divorce decree

      Delete
    14. U.S. citizen si Tom. Sya Ang nagfile ng divorce. Sa pagkakaalam ko , pag US citizen ang nag file ( kunyari husband is a US citizen or citizen ng any country where divorce is legal, tapos , Pinay wife) , kahit dito ikinasal sa Pinas, nirerecognize . Kung may church wedding din yun ang mahirap ayusin.

    15. 1:38 pwede po

      Delete
    16. 1:38 hay naku there’s no need for an annulment. Carla just need to file for a Judicial Recognition eto copy paste ko na.

A foreign divorce between a foreigner and a Filipino can be recognized in the Philippines if it was validly obtained according to the foreign spouse's national law. The Filipino spouse can file a Petition for Recognition of Foreign Divorce with the Regional Trial Court (RTC) in the Philippines.

      Delete
    17. There is a legal process called Judical Declaration of Foreign Divorce if one of the parties is not a Filipino or Dual Citizen. Look it up

      Delete
    18. 1:38 ikaw ang magaral ng law, Tom is a Us citizen when the divorce decree was issued. recognized sa Pi jurisdiction ung divorce nila thus no need to petition for whatsoever for annulment.

      Delete
    19. Regardless where a Filipino marries a foreigner, as long as the law of the foreign spouse allows divorce, the Filipino can enjoy the benefit of divorce here.

If US Law allows a Filipino spouse of a US Citizen to file divorce, it could still be recognized here.

Its gravely incorrect to say that divorce cant be had just bacause they are married in the Philippines. In the same vein, it is also incorrect to say that two Filipinos can get married abroad so they can get a divorce later on. The PH law doesn't allow it.

I hope 1:38 can re-read and update his/her legal knowledge before s/he antagonizes people simply enjoying a gossip site.

      Delete
    20. Carla can file recognition of divorce if Tom is a US citizen only, not dual. So kng US citizen lang si Tom, ire recognize lang ng Philippines.

      Delete
    21. Eh yun nagbida bida si 1:38 pero mali. Check the case of republic vs manalo in relation to art 26 of the Family Code.

      Delete
    22. 1:38 panoorin ang buong interview. Tapos na nga, after divorce sa US nagfile na din sila sa pinas at acknowledge na ng court kaya annulled na.

      Delete
    23. 1:38 may p under Philippine law ka pa, mali naman sinasabi mo.

Art. 26 of the Family Code nagpprovide na divorce may be recognized in the Philippines as long as the divorce will enable the Foreign spouse to remarry. Even 1st year law students know that since 1st year pa lang subject na ang Persons and Family Relations.

      Delete
    24. Yung kasal sa US yata ang divorced. Ganun nga ba?

      Delete
    25. 1:38 Carla filed for the recognition of the foreign divorce in our court which was granted, kaya free na din sya, Tom is not even required to file the same kasi Philippine laws does not apply to him, at least if he wants to get married again. Ikaw po ang magbasa Ng batas. Foreigners (na may divorce) marrying Filipinos can divorce their spouses regardless kung saan sila ikinasal

      Delete
    26. @1:38AM Wrong. It can be honored under Rule 39 of the Rules of Court by filing a Petition to Recognize the foreign decree of divorce.

      Delete
    27. 1:38 You're funny. Wag kang magmagaling. You can file in RTC the petition for recognition of divorce if one is a US citizen. You're welcome!

      Delete
    28. @1:38AM - “There is no divorce in the Philippines, but when a divorce is validly obtained abroad and initiated by the foreign spouse, the Filipino spouse shall have the capacity to remarry under Philippine law.”

      Delete
    29. 138 LOL nagyabang ka pa jan ha. wag kang fake news mamaru. under the PH Law any divorce legally obtained abroad and is recognized by the RTC of the petitioner's place of residence as valid IS ACCEPTED allowing the parties involved to remarry in the Philippines.

      Delete
    30. Umm, their foreign divorce can actually be recognized here by filing a petition in court.

      Delete
    31. 1:38 Study the law.

There is such a thing as Petition for Recognition of Foreign Divorce Decree. If non-Filipino citizen ang isa sa mga spouses, pwede ipa recognize dito ang divorce decree obtained abroad by filing such petition. Mas madali sya actually sa annulment and declaration of nullity of marriage basta foreigner ang isa sa spouses and his/her country has divorce law.

      -lawyer

      Delete
    32. 1:38 correct

      Delete
    33. Tom is an American citizen. He can file a divorce in the US even if they are married here and Carla is a Filipino.

Any of the parties will just file a petition for recognition of divorce decree here in the Philippines. No need to file a petition for nullity or annulment of marriage.

      Delete
    34. Basta US nagpakasal

      Delete
    35. 1:38, you can apply for recognition of divorce from another country.

Study the law deeper. Maybe not called divorce but ang effect, Carla can marry once ma-approve yung apply nia for the recognition nun divorce.

You can research deeper and you'll learn na madami na ganitong case not only for celebrities.

      Delete
    36. 1:38 kung si Tom ay US citizen lng and resident lng dito sa pinas he is considered a foreigner so pwede gamitin ang divorce sa US para ma recognize din dito sa pinas

      Delete
    37. I thought the Philippine law would recognize a divorce if one party is a foreigner.

“Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall likewise have the capacity to remarry under Philippine law.”

      Delete
    38. The divorce decree obtained in the US can be given legal effect in the Philippines by filing a Petition for Recognition of Divorce Decree in the court.

      Delete
    39. luh 1:38, bagsak ka ba sa family code/conflict of laws ? haha of course a foreign obtained divorce can be acknowledged under ph law as long as one of the parties is a foreign national with foreign divorce in his country
it just has to be pleaded and proved

    7. Yes. Carla can remarry too.

      Delete
    8. No. You can't be married in the Philippines, because walang divorce dito and kinasal kayo dito. You still have to file for annulment. Magpakasal ka sa US, puwede, kasi nga divorced is recognized sa kanila and American citizen si Tom. But si Carla need niya mag file for annulment if she wants to get married (again) here.

    6. 1:52 May headaches yan pagdating sa properties at rights sa legal documents once may mangyari sa partner mo. Hindi ka allowed to get a copy of his/her birth certificate (among other documents), hindi ka allowed to decide if he/she needs to undergo medical treatments (kahit emergency), and legally di ka nga considered na next of kin. So palagi mo dapat katulong yung family nya sa mga ganyang bagay instead na ikaw na mismo ang may say, lalo na if minor ang anak nyo.

When he was caught he turned the table around, kept telling friends that I was the one who cheated. There’s more , whenever he mentioned my name to his friends he used a lot of bad adjectives on me. After that I would prefer not to see him or deal with him in any circumstances. I didn’t allow my daughter grade 2 then to get close to him I tried but he blew it up instead of building a relationship with our daughter he bad mouthed me to her. Plus no financial support. Through prayers, faith and hard work I raised my daughter now she’s 25 and working in a multinational company and graduated magna cumlaude

On the other hand, kahit sa Pinas magpakasal ang pinoy at foreigner, they can validly be divorced at irerecognize yan sa Pinas.

Walang divorce sa Pilipinas pero if a Filipino is married to a Foreigner, they can be divorced at irerecognize yan sa Pilipinas kung yung divorce sa bansa nila will enable the foreign spouse to remarry.

Kahit saang bansa ikasal kung pareho naman Filipino citizen yung kinasal di sila pwede magdivorce.

Read Art. 26 of the Family Code.

  29. I went through the same thing with my first husband. My first husband was a US citizen and I asked him to file for divorce. When I got the divorce papers, I had to file for nullity of marriage based on divorce. Carla will have to do the same. We have to thank Corazon Aquino for that. It used to be that we can't even get an annulment even if the foreigner divorced us, that law was changed under her administration.
