7:01 solidary argument aside, the case has no foundation. It is akin to filibustering. The contract is between the driver and the agency. B's camp is a client of the agency, the agency being a service provider. The driver is the employee of the agency , an instrument to the agency's provision of that service. Problem is - B is not his employer, agency yun. Client ang brother ni B, and not B herself, ng agency. So walabg kinalaman si B sa employment issues ni 3-mos driver. Pati bro niya wala rin. Between his agency and the driver ang responsibility. Parang nag employ ka ng maid galing agency, and ang bayad mo sa agency. Unless may explicit na agreement, ang benefits and pay ng maid, galing yun sa agency at di sayo. Ano, magbabayad ka ng doble? Sayo nanif you want to extend extra benefits sa helper mo na extra sa kontrata. Pero yung legal responsibility talaga, between maid and agency yun, not you as the client ng agency. Yung GF ang nagsue kay B problema din yan sa validity ng claim. Di naman siya ang driver, wala naman suyang kinalaman sa work arrangement, di naman siya named sa kontrata. So nao ang standing ng GF at she sued B? Kaloka. Harassment lang yan.

DeleteWe got our company driver supplied through an agency. May rotation sila kasi 3 drivers sa company namin for our CEO then on call sa staff yung dalawa. We pay directly sa company kasi sila ang supplier ng drivers. The company pays them directly. The CEO's driver na assigned sa amin for the duration of the contract na, yung dalawa naman, rotate kung sino assigned ny driver agency kada week. Our company paid the agency in advance for the 2 year contract. Ang bayad ng driver sa agency na niya galing. Therefore, lahat ng benefits, pay and employment conditions ay responsibility ng agency not our company.

2:33 Bea can implead the agency if matuloy na makasuhan siya or she can sue the agency for reimbursement after paying. Solidary liability just means the employee can go after either or both of them but the solidary debtors can settle still among themselves.

Procedurally, it would be correct for the driver (NOT THE GF) to file a case against either or both bea and the agency. But as to the merits of the case, ibang usapan na yun.

7:01 solidary argument aside, the case has no foundation. It is akin to filibustering. The contract is between the driver and the agency. B's camp is a client of the agency, the agency being a service provider. The driver is the employee of the agency , an instrument to the agency's provision of that service. In fact, because of the behavior of the driver and his instigating GF, this is more akin to harassment. Why involve B? The client in the first place is her brother, not her.
