ReplyDeleteCH7 ang may pinakamalawak na reach sa free tv compared to TV5 at GTV pero sila pinaka-kulelat sa ratings sa noontime slot meaning people were still watching them dati dahil EAT BULAGA ang title ng show nila kaya ayan pakapalan na ng fez at mukang balak ng TAPE iexhaust lahat ng legal possible way to get the title back.

DeleteThey're not employees though. They're classified as talents, more like independent contractors. So whatever TVJ created, it's theirs. It's not a bad precedent at all. In fact it is a good lesson to everyone involved to seek the law to protect their rights.

But when Sarah and Georcelle had creative differences the latter demanded na hindi pwedeng gamitin ang mga choreography na ginawa niya for Sarah dahil she owns the copyrights. Georcelle was paid to begin with to make those dance steps, pero in the end siya pa rin ang may ari ng copyright.
DeleteI am not sure if this is applicable dito. Pero independent writer contractor ako sa isang radio program. May kasamahan ako nun na independent writer din na lumipat sa kalabang estasyon. Tapos lahat ng sinulat niya sa radio program namin, ginamit niya rin sa kalabang estasyon.

So, sino ang naglikha ng name at kondept na EB bago pa man ang TAPE? Ang Sagot si Joey de Leon at ang TVJ. That's all that's needed, no more points of argument.

ReplyDeleteActually kung susuriin nyong mabuti, kokonti lang ads nung TP, inuulit ulit lang yung mga ads ng same products sa isang adbreak para magmukhang madami/matagal ung adbreak nila.
DeleteNumber of ads should not be the only metric. You need to consider 1) Baka paulit-ulit yung TVCs playing meaning most likely, naka-promo ang TAPE sa advertisers or iilang companies lang nagtitiwala sa kanila and/or 2) Mura ang ad rates nila vs competition so mas madaling maaafford ng ibang brands.

The Trademark belongs to TVJ as the artistic copyright and creator rights belong to TVJ. To be specific, Joey.couned the term and the 3 grew that show over the years. TAPE is a financier, an investor. Investors can come and go but the product remains with the owner of the concept and the idea unless they sold it to TAPE which they never did. Simple, walang paligoy ligoy. Just think that after the ownership sa IPO is decided, affected na ang lahat ng cases. Precedent na yun. Ask any lawyer. Study precedents.
