Repost: Victor Consunji and Maggie Wilson Apparently Have a Prenup Agreement Contrary to an Earlier Post

There is an existing pre-nuptial agreement between businessman Victor Consunji and his former wife Maggie Wilson.

This after the Manila Bulletin obtained a document of the pre-nup which both Consunji and Wilson signed on Dec. 10, 2010.

Earlier, Wilson debunked claims that a pre-nup with her former husband does not exist.

In an Instagram Story, Wilson shared a certification from the local civil registrar of Bacacay, Albay that she had no pre-nup with Consunji.

It stated: “This is to certify that spouses Victor Sid Blanco Consunji and Margaret Nales Wilson have no record of any Pre-Nuptial Agreement in the office of the Municipal Civil Register, Bacacay.” It was dated Feb 14, 2022.

Consunji said in a separate statement: “I have resolved to enforce the existing prenuptial agreement, strictly and without further consideration.”

Wilson answered: “Is this why you want to send me to prison?”

But a document obtained by the Manilla Bulletin showed that there exists a pre-nup agreement between Consunji and Wilson.

Consunji is the founder of Victor Consunji Development Corp. (VCDC) while Wilson is a former beauty queen and actress.

On Sept. 27, 2021, Wilson announced on Instagram that she and Consunji had separated.

Merong notaryado, pero hindi naman nakafile sa tamang jurisdiction, ibig sabihin walang bisa.

  37. As per our Family Code, to be effective Prenup agreement has to be registered with local civil registry and register of deeds where properties are located before the wedding. Check the marriage certificate filled up by the spouses if they check the box as to existence of pre nup. The Certification from the Notarial Section only proves the existence of a notarized pre nup. But apparently as per Certification fr Local civil registry, the same was not registered.

  38. Just because there’s a notarized copy of a prenup, it doesnt mean that’s a valid document. The law requires that the notarized prenup must be registered BEFORE the marriage in the civil registrar where the spouses intend to marry and in the civil registrars where the properties are located.

  40. Let the court decide whether the pre-nup is valid or not. Both parties should have filed for it in the area where they held their marriage. Also, let's not discount the possibility of a fabricated one suddenly appearing and/or the error in the records in the earlier post.

  63. Strong pa rin naman siguro case ni M kung walang prenup na naregister sa local civil registry. Pero imho, tagilid siya kung meron nga at naregister yan sa registry of deeds kasi may annotation yung titles ng personal properties (which i'm pretty sure meron si V) tapos kasama sa list yung stock certs. So pwede nila ilaban na meron talaga at ang nagkamali yung local civil registry which is not unheard of naman.

  74. Both M and V could be telling the truth. A pre-nuptial agreement exists, signed and notarised, but it was not filed with the local civil registry where their marriage contract was filed and the Register of Deeds.

    Question to lawyers here (if any): Does a procedural oversight affect the validity of their pre-nuptial agreement?

  80. How To Make a Valid Prenup

    Legal Requirements

    Philippine law requires (See Article 77, Family Code of the Philippines.) that, in order to be valid, a prenuptial agreement or any modification must be (a) in writing, (b) signed by the parties and (c) executed before the celebration of the marriage.

    And in order to bind third persons, the prenuptial agreement must be (d) notarized and (e) registered in the local civil registry where the marriage contract is recorded, and (f) registered in the proper registries of property.

    Registration

    The registries refer to the local civil registry of the city or municipality where the wedding was solemnized/celebrated, and to each of the registry of deeds where the couple has real and personal properties subject of the prenuptial agreement.

  83. I still find something's fishy here. Remember, V will do everything in his power (esp wealth) to make sure M will go to prison and will not get any single cent from him. But M should be wiser by now. Every time she post something on socmed, the other party is ready to refute everything she claimed. Better discuss it with your lawyer, M.   87. Ewan ko bakit naniniwala karamihan dito un may seal daw? Kung totoo na ifile yan dapat galing sa LCR ang pinakita ni VC. Certification lang yan kunwari na may copy ng prenup pero hindi na ifile na pwede maquestion sa court hearing nila. Mala Jamine Chua at ex husband ang issue na ito sa conjugal Properties din at issue din ng Gold digger daw si Chua pero nanalo sa kaso
