      Kay Whang Od, hindi siya English speaker, may NCIP protecting the indigenous tribes na kailangan in consult, at cultural asset yung binebenta. Different laws for a different scenario.

  3. I think all family members should talk first. Kasi mukhang yung family members lang na present yung nag-agree dito, hindi na-inform yung iba. They might not be aware of the ramifications of their actions and how it violates their tribe and their own traditional cultural practices such as mambabatok.

      Ang mahirap kasi sa pamilyang Pilipino, may iba't ibang agenda. Kawawa naman si Apo, parang ang dating eh her own family members are taking advantage of or letting others take advantage of her.

  10. I feel like the context of the contract ang whatever clauses na meron were not fully explained or understood by both parties. Nakaawa si Apo. May contract or wala, Nas shouldn't have exploited her knowing na ang tanda nya na. Tapos maniningil sya ng 750php for a centuries old tradition tutorial? Hello naman nasaan ang respeto?

    4. That doesn’t prove anything. The contract should be written in their native language, huwag umasa sa verbal translations. Hindi tayo syre kung tama ba ang pagkakatranslate. The other party probably did’nt understand the contract well and the implications na dala nito. If they really cared, they should have spent time translating the contract in their native language so that the other party will have a better understanding of the agreement.

Yung mga ganyang contracts are crafted and worded na hindi basta maiintindihan ng layperson kahit sabihin mong anjan ung isang kamag-anak. Considering the age of Whang Od and the lack of legal knowledge sa side nina Whang-od, hindi mo macoconsider na nag-bigay ng proper consent si Whang-od. Hindi ka pwedeng iconsider ng law na pumayag sa isang kontrata na hindi mo naiintindihan. Para kang na-goyo or na-scam.

  18. Imaginine nyo, batok is a traditional tattoo na I guess takes time to get to know and to learn tapos gagawin lang tutorial online. Tapos kapag may napahamak dahil sa tutorial na yan, baka masisi pa si Apo Whang Od. This is really not appropriate and really is just exploiting the culture.

  19. What do the DTI and NCAA say about this? Both parties should have protected Whang-Od, or was an under-the-table enough? Everyone knows that ANY businessman is scamming - if he profits from a senior citizen who is prone to senility and decline of judgement and cognition, especially one who is over 90 years old, cannot speak, write or understand modern language much more a multi-worded, MULTI-PAGED contract!

    Are those her Official representatives and lawyers? Looks like some relatives are profiteering as well! The contract should have a representative of the Government, Her official lawyer and representative, the LGU, DTI and NCAA - This is an ENDANGERED NATIONAL TREASURE - Otherwise this is ILLEGAL! Our cultural property is being exported and distributed illegally!

    What would you say if we had ALL our Philippine Eagles captured and BOUGHT by this businessman for cross-breeding with American chickens to be taken as Florida pets? Thank you for loving our culture and resources, Pinoy pride?? The NCAA should protect her lineage and culture - bakit hindi ang Department of Culture and gumawa ng accredited teaching methods? Aside from that, ang involve dito is un culture ng tribe ni Apo and to do that, dapat daw may consent ng NCIP natin kaso wala. Ang kapal pa ng mukha neto ni NAS magrebutt.   24. Whether legit o hindi yung contract, culturally speaking BAWAL YUNG GINAWA NILA dahil ang pag babatuk ay pwede lang ituro/ipasa sa kamag anak. Direct bloodline. Salinlahi lang sya. Kaya nga sya literal na “dying art”. So yung pagtuturo sa ibang tao na labas nang pamilya is a big no no no. Actually this is a bigger issue than Nas Daily monetizing the art. Hindi naman siguro mag kakaidea si Nas na pagkaperahan kung walang nagbigay sa kanya ng idea.

Kumabaga living National Trasure na 'yan, lumang era palang mambabatok na si Apo Wang Od at hanggang ngayon sa makabagong panahon buhay pa sya. Jusme dapat protektahan ng pamahalaan si Apo at iba pang katulad nya na yamang katutubo ng Pilipinas!

    So what is the problem? First, Nas Daily does not understand Kalinga culture. Whang-od is not just an individual artist but she is also a member of the Butbut Tribe of Kalinga. Her skill on the art of traditional tattooing is derived from the indigenous knowledge of generations of Kalinga ancestors. Thus, this indigenous knowledge is collectively owned (although it may be individually practiced) by the Butbut. Thus, the consent of the members of the Butbut is necessary if this knowledge is to be shared to outsiders. Getting the permission of one individual is not enough.

    Secondly, Nas Daily does not know Philippine law, more particularly Republic Act No. 8371 or the Indigenous Peoples Rights Act (IPRA) and its Implementing Rules and Regulations. Free and prior informed consent (FPIC) is required when the knowledge of indigenous peoples is used for commercial purposes. This consent is secured from the members of the ancestral domain, in this case the members of the Butbut Tribe and not from just one individual or her family. This is especially true of the Whang-od Academy will reveal to outsiders about the indigenous community's rituals. The agreement between the parties should also be written in English and the local Kinalingga language and witnessed by the National Commission for Indigenous Peoples (NCIP).
