    3. 12:54 palusot dot com eh di dapat sya una nag file ng kaso sa Viva for breach of contract. You cannot take the law into your hands.

    4. 12:54 how exactly did Viva breach their own contract?

    7. 40% cut her for the last 15 years! She still honors existing third party contract originally made with viva but viva breached when they dont consider her wishes, preferences, educational request and stuff. So she has every right to terminate it and go thru arbitration. Who wants to be tied to that for another 15 years?

    2. 12:26 andami kasi prinoprovide and ginagawa ng viva for her, so its kinda understandable why

      Delete

    4. They have even bigger stars than her and they did not complain. She should have done all the conplaining nung walang wala pa siya. She was given projects after projects pero d pa rin siya kuntento. Other artists who wants to have a lead role on big screen never got thw chance. Viva gambled a whole lot of money on her. She does not have the x factor to becone a big star and yet she was given the chance. Why sign a contact if you cant honor it. Kapunan surely will give her client reassurance for obvious reasons. I used to like nadine but the fillers that she put on her face went to her brain. She better do some reality check before it is too late.

    5. 40% I think used to be 50% pa nga normally for artists and managers nila. Nothing wrong with that to think na overhyped siya and walang ROI, swerte pa nga yan sa VIVA kaya lang inggrata eh

      Delete
    6. 30% is the STANDARD COMMISSION OF TALENT MANAGERS

      kapag mas malake ang kita
      E.g. MILLIONS in endorsement
      20% lang

      Delete
    7. 12:36 depende sa meaning ng breach of contract by Viva, pwedeng hindi sila nag provide ng make up artist or stylist sa isang event. Still malaki ang 40% usually 15-30% ang cut.

      Delete

      Delete
    9. 40% is still big. Di rin naman ganun ka engrande promotions sakanila or even their outfits. Nasa range ng 20 - 25% yan.

      Delete

      Delete
    11. No name naman kasi sila dati so ano ba naman ang 40% compared sa walang trabaho? Then again, ang dami namang bigger stars sa Viva. Ano yun, di marunong magnegotiate si Nadine? At least sana pinaliitan nya ang duration from 10 years, di ba? And better exit clauses?

      Delete

      Delete
    14. 4:02 Wag kang butthurt. Depende sa laman ng contract and kung beneficial siya pagsikat then YES go! Which is what she did. Pero umalis si boylet ex sa Viva so guess what happened? Let’s be real sa real reason.

Kapag ang sinasabi mo galing sa puso, you become an eloquent speaker, you don’t think about it and words come out naturally. Isa pa, gusto nya pasosyal na English kahit hindi nya forte ang English language kaya nangangapa sya sa English words to express her thoughts.

      Delete

    1. True naman. Meron naman shang parents na ksma before she agreed and signed yung contract.

Kaloka.

      Delete
    2. Hindi po normal ang 40%. Actually that's a slave contract na. And the law should be protecting artists from contracts like that.

      Delete
    3. Yup if you signed the contract then it is supposed to be honored. She is very lucky na mababait sila boss vic. Kinawawa lang nya :)

      Delete
    4. As far as I know, parents ata niya yung nakipag negotiate with Viva since she was still a minor nung signing ng contract so wala siyang say.

      Delete
    5. 12:58 hindi talaga normal and 40% kasi 50% pa nga yan dapat. You’re such a tard

      Delete
So di mo na masisisi yung Viva. Pinirmahan nya, nag-agree sya.

  14. I just wonder why Viva revised the subsisting 5-year renewal contract of Nadine halfway thru (after 2014 and before expiry in 2019) and added another 10 years to it to expire in 2029, or a total of 15 years for a renewal contract. Let’s just suppose the fact that James Reid’s contract was expiring on 2019 without renewal, and Viva deemed fit to lock in Nadine to Viva so James Reid and Nadine Lustre cannot both run away with the “Jadine loveteam formula” under their cape. As to why Viva was able to forge a “slave contract” on Nadine halfway thru and at that time she was no longer a minor and can sign the contract did not have the likes of Atty Kapunan review that revised contract is the question. It’s too late after you have signed the contract, Nadine.

      Delete
    2. THIS! for such contract, need na talaga nya magconsult ng lawyer

      Delete

    ReplyDelete
  24. yes 40% cut is such a steal BUT nakinabang ka naman sa viva at nagkapangalan. 15yrs, maybe a long time but sometimes it takes so long bago mapasikat ang artista. look at jodi sta. maria, recent na lang sumikat kahit ang tagal na nya sa star magic. point is, hindi nagrereklamo si nadine against viva nung baguhan sya. nakatikim ng konting fame, lumaki ang ulo - naging pasosyal pa. i'm with viva on this one.

  27. Just because there is a signed contract between the parties doesn't mean that the contract is legal. If a contract is severely unfair to one of the parties such that it becomes unconscionable, it can be deemed unenforceable under the law. Not all parties to a contract are on equal footing when they are at the bargaining table. In this case, Nadine was a minor and Viva had the experience, the power, and the resources. She may have been pressured to sign because she thought it was her lifeline. Imho, a 40% cut and a 15-year-long contract is unconscionable.
    - Not a fan, just someone schooled in the law

    ReplyDelete

    1. How old is she? Pangalawang sign na ata niya yan. If nagsign siya 5 years ago pr 6 years ago di na siya minor. If minor man siya hindi ba kasama ang parents magsign sa ganun?

      Delete
    2. Uhm? It was not a full on 15 year old contract. And when the contract was extended she wasn’t a minor na when she signed. It’s her fault that she didn’t read it and negotiate kung feel niya na slave contract yung pipirmahan niya. Walang pilitan dito. She was not made to sign at gunpoint. And the fact that QC RTC already decided that the contract is legal and binding means valid yun. Anong pinagsasasabi mo? Maybe you should read back and check the decision on a previous post. You’re too late sa balita.

      Delete
    3. since she was a minor, then most probably, her parents were with her to advise her and all, pero still, na pirmahan yung contract...if she was dehado,or pressured, dapat noon pa, kumuha na sya nang lawyer to deal with that.

      Delete

      Delete
    5. A contract is not for convenience of Nadine, too. Take it or leave it. You sign it, then you bind yourself. C’mon don’t play the victim card for Nadine. Only Viva took a chance on Nadine when she was a nobody; now that she is thrust into the limelight and made bankable by Viva, she bites the hand of Viva and wants all the money for herself. That’s more greedy on her part especially in the Filipino culture of - utang na loob.

      Delete
    6. But nag renew na siya diba? Minor pa ba siya when she signed a new contract with Viva?

      Delete

      Delete
    8. sus, if you are schooled in the law, you should have known that signed contract enjoys presumption of regularity and validity. the burden of proof rests on the party who assails its validity.

      Delete
Just do the math!!! At kung ayaw mo wag mo pirmahan. Simple.

      Delete
    10. 11:42, you talk nonsense. You are “schooled in the law” yet you don’t understand the law. Too funny. What’s the use of a signed contract if it’s not valid?

      Delete
    11. Yan din ang pagkakaalam ko pero it was already brought to court and despite all that the court still ruled in Viva's favor, unfortunately. Tsk.

  30. Nadine owe a lot from VIVA. di sya binitawan all throughout her career journey and transportation from being part of a girl band, playing bit roles in movies, casting her in TV series and appearances. I think she should learn to show gratitude in return.

40% was not enough to build her and make her what she is now. she never either had a name when handled during her day1 in the agency in the first place.

  33. Very awkward na situation ni Nadine. Feeling ko she needs advice from friends/mentors with more maturity, masyado na kasi sya napapaligiran ng mga pa-cool friends na petiks-petiks lang, puro mga laki sa layaw. I admire her for wanting creative freedom (in fairness angat naman yung quality ng music videos nya ngayon unlike the usual cheap baduy productions na typical sa Pinoy showbiz) pero she can't just walk out from her obligations or throw tantrums. Even if she's unhappy with Viva she has to act professional and settle her affairs ng maayos

  34. Kadiri yung kumakampi sa oppressors. 40% cut is too much, more than 10 years contract is too much don't compare it sa mga idol nyo because you don't know kung iba or pareho sila but im glad she tries to fight it.

  35. Mas maganda kung ituloy hanggang Supreme Court ni Atty Kapunan ang issue ng revocation of agency contract at will by principal. Para magkaroon ng jurisprudence sa mga talent and agency management relations kung ano ang reasonable terms and conditions. Di kaila na sa kalakaran ng monopolya sa talent agencies, madami din na struggling artists na naabuso in terms of oppressive and unconscionable terms at wala sila magawa kundi tanggapin ang mga onerous contracts ng isang malaki na agency kagaya ng Viva atbp.

    ReplyDelete
