  1. Yes, It does says in RA8504 that HIV should be confidential, but there are "Exemption to mandate that confidentiality" and that 1 person who has the HIV never did nor apply the following sanction of having HIV.

    Ms. wurztbach should read the whole article before saying something like this..

      The PDEA action was not an exemption. As it is, PDEA knew their blunder that's why they immediately issued a public apology.

  2. Preach Queen P! Mali talaga yung ginawa ng PDEA. I understand that drugs was involved, but to sensationalize it and create a stigma in the gay community and PLHIVs is wrong! Sobrang nakakagalit at lungkot magisip ng ibang tao! Whatever happened to kindness and compassion? They broke the law by using drugs, and they should be punished for it. But to also insinuate that they’re gay and one has HIV is unlawful.

    1. Theres no sensationalising or stigma created, it is what it is. Illegal party drugs was present and thats what made it even worse. Again no judging but what is moral in an orgy or group like them doing what they are doin? It was totally embarrasing but who wouldnt be? To Pia why criticize PDEA for just doing their job and doing the right thing, dont try to cover up wrong doing of others just to push your misdirected advocacy. It is sexual promiscuousity that spreads HIV and that is one best example to educate the youth. To be careful with their actions as there are consequences. These guys are humiliated bcos they chose to be and its not PDEAS doing. And no need to insinuate they are gays besides whats wrong if they are what is wrong is what they are doing.

    3. @5:18 1. RA8504 as clearly states that it is unlawful to disclose the HIV status of any person unless kung related sa case. in this situation the HIV status doesnt have anything to do with them using drugs.
      2. kung immoral man ang orgy wala na dun ang PDEA. sa kanila lang ay ung pg enforce ng batas. last time i checked morality and laws are two very differenr things

      Last time I checked, it's also illegal for a person to spread HIV. Being in an orgy makes it more offensive. Plus, confidentiality issue? No one disclosed the information with "who" is the carrier. They just made the general public aware that in these "orgies" there might be one who's contaminated. Di ba madami nang matatakot? And it would lessen the spreading HIV?

    7. Anon 9:32 you bave a point pero I think tama lang talaga na dinisclose ng pdea yung name para din naman maging aware yung mga naging partner niya before, who are not involved dun sa drug raid. Obv naman na kahit alam na nung tao na postivie siya e active pa din yung sex life niya. And I don’t think people around him knows that he’s positive. So, it’s also a way to spread awareness to those people who have been part of his sex life.

    9. @1:06 Public health centers have a contact tracing system for HIV past sexual partners. that’s the proper way of doing it. Hindi ung ianounce sa media ng basta2x. Please educate yourselves people. Attend HIV forum once in your life. Ako’y sobrang nababahala na ganito pala ang pananaw ng karamihan up until now on HIV. We have so much more work to do!

And there’s a chance that he couldn’t remember some of them because he was too intoxicated when it happened. He’s also aware that he’s postive but is he being responsible about it?   3. IMO, the HIV positive arrested should not be participating in drug-fueled orgies. Even if he is taking medications. Just to be in the safer side. While high with drugs, there is a chance they will recklessly not use protection while having sex. And it's doubtful if the HIV positive disclosed his condition to his prospective partners.

    I agree with Pia that the PDEA et al should not have announced the positive status. But I am in the view too that this incident is an eye opener for everyone to practice safe sex and to be more responsible with oneself whether you are straight or gay. You should not put yourself in situations that could compromise your own health and safety.

  4. yes that this hiv person is protected with that law. But the question is "does he know that he's positive before joining?" If the answer is yes that a different ball game. He's there to spread the virus. And people should be aware of it.

IMO too, dapat na sigurong baguhin ang batas na hindi dapat e disclose kung HIV positive yung tao, so ano na lang to? hulaan kung sino ang positive at sino ang hindi? awareness diba? dapat aware din yung mga walang AIDS, as well as yung mga may sakit, time to be more open minded. AWARENESS for all.

Parang LGBT lang dati, Aminin natin sobra ang stigma ng tao but eventually accepted sila. though may ibang sectors na still hindi pa sila accepted.   11. pia you are not working hard about HIV info dissemination because andami mo ngang maling nasabi. may reason naman siguro bakit inexpose yung HIV status kase kng drugs yun and hindi lang shabu edi nag sshare sila ng needles so automatic they have to trace. ito talaga walang alam kundi magpaganda

Sa Pilipinas masyadong gamit ang freedom of speech at ang lakas ng CHISMIS MENTALITY na kahit mapa media o government agency, walang sense of privacy and responsible ways of communicating the message.

    1. The person with HIV disclosed his status to them because they found HIV medication with him. So I guess, layunin ng PDEA na iparating sa mga naging parties or swingers to come forward at magpatest?

  15. I think PDEA is doing a wonderful job, yang mga yan addict at supplier ng mga droga, kaya dapat lang na mahuli sila. Nagkataon lang na lgbt sila. But nevertheless, what they did was a crime. Buti at hindi sila natukhang, hinuli naman sila ng maayos.

  16. To divulge the truth is part spreading awareness, these people who got HIV should be open about their situation, the reason why they are shunned is because the truth about them are being kept confidential. If they are open and honest then i guess people will understand and embrace reality.

  17. The comments here clearly show the state on where some Filipinos are, not just on HIV awareness but also Duterte’s war on drugs. We all agree that it is a detriment to our society but the willingness of people to accept PDEA’s error in inadvertently creating stigma on HIV and homosexuality is telling. These people justify the lawlessness on the war on drugs and the lack of due process, this might not be an example of extrajudicial killings but its definitely a similar approach that some see as an acceptable practice. Before we can grow as a country, we need to realize laws and acknowledge them for these are created for a reason.

  20. awareness is needed, may it be negative for publicizing the identity of the person involved still it will serve as an awareness and its a lesson to be learned. nakitaan sya ng gamot for maintainance ng hiv. so he is aware na may sakit sya but still gumamit parin sila ng drugs with syringe and nag orgy sila so he might spread his disease. they are professionals already alam nila ang tama at mali. sadly they have to face the consiquences. wag na taung magbait baitan at ipagtanggol ang mali sa tama.

  22. sa states its a HIPAA violation and can its a possiblity of lawsuit bigtime. regardless of circumstances once health info was leaked and very sensitive the person has all the right to file a case because they violate the HIPAA law im not sure if its applicable in the PHilippines. I know about HIPAA because I was a manager here and they discussed to us how important HIPAA is all about not even showing the doctor's excused to others its a very strict law and needs to follow at all times.

  25. in reality, if you have sex with anyone, you run the risk of having std. You and your partner may have the disease without knowing it. Kaya ang magandang gawin is promote and educate people about safe sex. As in ituro ng mabuti ang mga ways and at the same time, i-encourage sila to self check lalo na if you are sexually active. Always be pro active in protecting yourself ika nga.
