Repost: BIR Files Tax Evasion Case Against Richard Gutierrez and R Gutz, Annabelle Rama Cries 'Harassment!'

The Bureau of Internal Revenue said Friday it filed a P38.57-million tax complaint against actor Richard Gutierrez and his production company.

Gutierrez, 33, allegedly underdeclared P39.6 million in sales in 2012. His company, R Gutz, also failed to file an annual income tax return and two quarterly value added tax returns during the same year, the BIR said in a statement.

“As a consequence of their acts and omissions, R Gutz and its president, Richard Gutierrez, were assessed an estimated aggregate deficiency tax liability for taxable year 2012 in the total amount of P38.57 million,” the agency said.

Gutierrez and his company declared P311,111 in sales in 2012. However, their clients said they bought P39.9 million from the entertainment firm during the same period, based on a list of purchases.

The actor's mother, Annabelle Rama, dismissed the tax case as "harassment." Rama said her son could prove that he filed tax returns properly.

Rama cited the daily notices from the BIR to the family's house.

The family's lawyer, Marie Glen Abraham-Garduque said the actor had not received a copy of the BIR complaint.

"He (Gutierrez) will answer at the proper forum as soon as he receives it," Abraham-Garduque said.

The BIR filed three other tax evasion cases on Friday, and a total of 21 since the Duterte administration took office in June last year.

Gutierrez first shot to fame as a child star, starring in a milk commercial with his twin brother, Raymond.

He later starred in fantasy soaps on television. He is currently in a relationship with actress Sarah Lahbati. They have a three-year-old son, Zion.-- reports from Ina Reformina and Mario Dumaual, ABS-CBN News

  8. Yan ang dapat alam ng mga artista, when they deal with corporations marereport ang income nila. So they should show/report the same amount of income as in all those creditable tax certificates issued to them.

  19. What is harassment there Madam Anabel? A regular employee, kada sweldo, kaltas automatic ang tax due to them, eh si Richard sabi mo nga eh milyonaryo na. As you said kahit walang project lately eh can afford to travel. Now prove BIR is wrong.

  23. Seryosong tanong lang po: yung 38.5 million na utang ng RGutz sa tax, was that just for 2012? Or was that from 2012 through 2017 plus interest? Para po kasi ng sobrang laki.

    4. Ung 38.5MM is the amount to be settled sa BIR malaki talaga yang babayaran niya kasi ilang taon na nilakaran ng undeclared sales nila. Malaki penalty, surcharge at interest nun.
