Repost: House Justice Committee Approves Death Penalty Bill

The bill restoring the death penalty passed a major hurdle in the House of Representatives with its approval on Wednesday at the committee level, paving the way for the measure to be taken up on the plenary floor.

With its swift approval, the measure allowing courts to impose death as punishment for heinous crime — one of President Rodrigo Duterte’s campaign promises — may be debated and possibly passed on third and final reading before Christmas.

By a 12-6 vote, with one abstention, the justice committee chaired by Oriental Mindoro Rep. Reynaldo Umali approved the substitute bill consolidating several similar measures reimposing the capital punishment for more than 20 heinous offenses, including rape with homicide, kidnapping for ransom, and arson with death.

This followed a nearly three-hour long debate by lawmakers in favor of or opposed to the death penalty bill, one of the priority legislative agenda pushed by Mr. Duterte, along with measures lowering the age of criminal liability and switching to federalism.

Albay Rep. Edcel Lagman and Dinagat Rep. Kaka Bag-ao articulated spirited objections against the approval of bill, arguing that there were no compelling reasons to justify the reimposition of the death penalty bill.

But their arguments fell on deaf ears in the face of the majority.

Leyte Rep. Vicente Veloso, a former Court of Appeals justice, said it was important to give courts the option to impose the penalty of death against the worst and most hardened criminals.

“If the one in front of you is Satan himself, at least give the government the option to kill the person. That’s Satan already,” he said.

Bag-ao begged to disagree with Veloso, saying most of those who would end up facing death as punishment for their offenses are ordinary people.

“It’s not Satan who would face the courts, but ordinary people, many of them among the poor,” she said.

She also cited Philippine Statistics Authority figures showing that the period when the death penalty was imposed did not indicate any decline in crime numbers. In fact, she said, the numbers showed there was more crime during the time capital punishment was in effect.

But Umali, the committee chair, later presented figures submitted by the Philippine National Police showing an opposite trend where criminality had started to rise after the death penalty was abolished.

Seeking to put an end to the debate, Majority Leader Rodolfo Fariñas noted that the framers of the 1987 Constitution, many of them devout Christians, had opted to keep the option of capital punishment.

“When they framed the Constitution, if they thought the death penalty was wrong, they should have abolished it in the first place. But what they did was set it aside. They said it could be revived if Congress wanted to,” he said.

He further noted that Mr. Duterte was elected by the Filipino people after he promised to reimpose the death penalty and to litter Manila Bay with the bodies of criminals.

  9. Siguro nga kailangan nating ng harsher punishment sa mga kriminal, lalo na kung buhay ng ibang tao ang sinisira. Ang nakakakaba lang dito ay ang kalakaran ng hudikatura sa ating bansa, nakakatakot na kapag mas may pera ang nakalaban mo sa korte ay mahirap na maipanalo ang kaso kahit pa inosente ka. Katibayan na lang ang mga anak/pamangkin ng mga pulitiko na nasasangkot sa drugs, heinous crimes, traffic violations at kahit pa yung mga naikulong na ay bukas-makalawa nakakalaya na, lalo na kung tama ang koneksiyon mo.

    Minsan sa buhay nila. Araw araw nag cocommute ako, grabe takot ko sa mga holdapers, snatchers, rapists! Hanggang matulog ako takot ako sa mga akyat bahay at kung anu anu pa. It's about time may katakutan na ang mga tao. Wag na natin ipagtanggol ang mga kriminal.

Masyado ng madaming criminal sa pinas, it's about time na mawala na ang mga takot natin at maibalik ang disiplina. In the first place pres du30 won bcos of his promise na totally mawala ang criminality sa pinas. So pls make this happen

  13. KAramihan naman kasi talaga sa mga mahihirap na criminal eh matindi ang ginagawa, nangnanakaw na, nang-re-rape pa tapos papataying at mahihirap din madalas nila mabiktima. Tama lang yan.

  15. I fully support death penalty for heinous crimes and drug related cases. OA naman kasi makareact yung iba kung makakontra akala mo pagkahuli eh papatayin na, syempre may due process. Kung napatunayan na pumatay, nangrape, nagtulak ng droga, kailangan turuan ng leksyon.

  17. Pabor ako diyan pero higit sa lahat dapat ireporma ang judicial system sa atin, napakabagal ng hustisya at napakaraming corrupt na mga pulis, judges, etc. Pero heto, sa nangyayaring sistema sa kasalukuyan, mas malamang ang mahihirap lang ang masasalang sa death penalty.

  20. Ok lang ang death penalty. Pero masyadong selective ang justice sa atin. Wala pa akong narining na mayaman na binigyan ng death penalty. Saka kahit mag-impose ng death penalty, hindi naman titigil ang krimen sa atin unless masolusyunan ang root ng disparity sa atin, which is ang kahirapan.

    Saka isama rin nila sa death penalty ang mga corrupt na pulis at politiko.

  21. Finally. Now, punish too some of the juveniles who commit heinous crimes. Please ratify Kiko's bill. Because in some places, 7yrs is already considered as age of being responsible for a crime.

    2. 4:07 I assure you it's true and it is the law where I am now. The juvenile delinquents are well cared for though. They don't lack anything while in detention. And let us be honest, there are kids that young who have committed crimes. Even with proper guidance.

  24. Paano pag ang nabigyan ng verdict eh maling tao..eh napatay na...lumabas ang katotohanan inosente pala... Ok ba sa inyo yun? Para saken ....life imprisonment na lang kasi may chance pa syang magbago...

  25. Papayag ako kung hindi corrupt ang gobyerno pero sa tulad na republic natin, maraming mahahatulan ng hindi tunay na nagkasala. Sa america nga na mayaman bansa may mga maling nahatulan, sa atin pa kaya na binabalutot ang tama. The government can not assure us 90 percent na tamang justice. Not kow that the president and his allies are abusing the power.

  29. Patunayan muna ng supreme court justices na hindi sila nababayaran and they are wise enough not to put an innocent person on death row. At pagisipan naman nilang maigi yung crimes punishable by death penalty, planting marijuana?
