Repost: Supreme Court Allows Grace Poe to Run for President

In a landmark ruling, the Supreme Court (SC) decided to save Senator Grace Poe from disqualification as presidential candidate in the 2016 election.

The SC en banc on Tuesday, March 8, voted 9-6 to reverse the decision of the Commission on Elections (Comelec) to cancel Poe's certificate of candidacy (COC).

Chief Justice Maria Lourdes Sereno was among the 9 justices who voted in favor of Poe. The rest are Presbitero Velasco Jr, Diosdado Peralta, Lucas Bersamin, Jose Perez, Jose Mendoza, Marvic Leonen, Francis Jardeleza, and Benjamin Caguioa.

Of the 9, four are appointees of President Benigno Aquino III: Sereno, Leonen, Jardeleza and Caguioa.

The 6 justices who voted against Poe are Antonio Carpio, Teresita Leonardo de Castro, Mariano del Castillo, Arturo Brion, Estela Perlas-Bernabe, and Bienvenido Reyes.

Of the 6, two are appointes of Aquino: Bernabe and Reyes. Three of them – Carpio, Brion and De Castro – were part of the Senate Electoral Tribunal that earlier voted in favor of Poe. The 3 justices dissented in that SET verdict, insisting that Poe is not a natural-born citizen. 

The verdict came after recent surveys showed Poe as the front runner in the presidential race.

The High Court heard oral arguments on the case for 5 Tuesdays, from January 19 to February 16. The SC justices interpellated Poe's counsel Alex Poblador, Comelec's lead counsel Arthur Lim, Solicitor General Florin Hilbay, and former University of the East Law Dean Amado Valdez.

During the oral arguments, the views of at least 3 justices showed they were leaning toward recognizing Poe as a natural-born Filipino and as having established residency before running for president: Sereno, Leonen and Jardeleza.

Sereno and Leonen focused on the rights of foundlings, while Jardeleza expressed his concern that the Comelec might have deprived Poe of her rights to due process.

3 bodies

Poe fought disqualification cases against her before 3 bodies: the SET, Comelec, and the SC.

It was a close vote at the SET. In November 2015, the SET voted 5-4 to deny the petition to disqualify Poe from the 2013 senatorial polls.

A month later, in December 2015, the Comelec en banc decided to dismiss Poe's appeal to allow her to run. The commissioners voted separately on the two cases involving the senator's citizenship and residency requirements: the one handled by the First Division and the other by the Second Division. Both divisions previously ruled against Poe.

At the SC, the oral arguments showed that the justices were split on at least least 4 key issues on the case.

    5. Hindi Lang naman Kay grace Poe ang issue ng foundling at citizenship. Madaming mga trabaho na ayon sa batas ay kailangan natural born tulad na ng pagpasok sa military. May mas malaki kasing epekto ang desisyon na ito na Hindi laman sa pulitika. Hindi ako boto Kay Poe pero sana iniisip din natin ang mas malaking issue na nais tugunan ng desisyon na ito.   4. It's saddening that the Supreme Court justices can't even interpret the basic definition of Natural Born citizens (based on 1987 Constitution) "...who are citizens of the Philippines from birth without having to PERFORM ANY ACT TO ACQUIRE OR PERFECT THEIR PHILIPPINE CITIZENSHIP.."

    Grace Poe had to reacquire her Philippine citizenship (having renounced her American citizenship) which nullifies her as a Natural Born Filipino citizen.

    And her husband and son can't even vote for her because they themselves haven't renounced their American citizenship.

  7. Dapat bang iboto yan? Nung greener pasture sa US, dun sya nagpledge of allegiance at dinenouce ang Philippine citizenship. Pero nung nakakita ng raket sa pulitika sa Pinas, sabay drama na Filipino sya. Nakikita kung anong klaseng pagkatao meron tong si Poe.

  17. Maraming pilipino ang pinipili na manirahan sa ibang bansa at kalaunan maging citizen. Habang patuloy na nagbibigay tulong sa kababayan at kamag anak na mahihirap. Hindi n ba sila pilipino?

  23. pwede ba Poe wag mo gamitin issue ang pagiging ampon . ang tunay na issue dito ang pagiging american citizen mo at kakulangan ng residency mo sa pilipinas nung nagfile ka ng candidacy. kung tutuusin dapat di ka qualified nung binoto ka as senator. why would we vote for u eh mismong asawa at anak mo american citizen pa rin

  28. no.. we will not have an american first family. never. spread the word. we shouldn't allow that. she embraced US citizenship for her convenience. when she saw opportunity in the philippines, she more than happily came back. it was sooo convenient for her that time and why? because she will hold a public office but will continue to enjoy that life that she has. where's the sacrifice there? in her campaign sorties, she keeps on promising the moon and the stars. my foot. she acts and talks like a trapo. a devil in sheep's skin. pag pinairal ng pilipino ang puro emotions, and will vote for her, we gave away our beloved country to the dogs. so please lang... never a poe. never a chiz.
