Repost: Comelec Division Disqualifies Poe from 2016 Presidential Race

The Commission on Elections (Comelec) has disqualified Senator Grace Poe from the 2016 presidential race for not meeting the residency requirement of the Constitution for presidential candidates.

In a 35-page resolution, the Comelec second division said it voted 3-0 in favor of the petition filed by lawyer Estrella Elamparo, who is seeking the cancellation of Poe's certificate of candidacy for president.

The division sided with Elamparo's argument that Poe failed to meet the 10-year residency requirement mandated by the Constitution for a presidential candidate.

"Wherefore, in view of all the foregoing considerations, the instant Petition to Deny Due Course to or Cancel Certificate of Candidacy is hereby granted," the division said in its resolution.

"Accordingly, the Certificate of Candidacy for President of the Republic of the Philippines in the May 9, 2016 National and Local Elections filed by respondent Mary Grace Natividad Sonora Poe Llamanzares is hereby cancelled," it added.

The members of the division are Commissioners Al Parreño, Arthur Lim, and Sheriff Abas.

Poe's running mate, Sen. Francis Escudero, confirmed that she was disqualified by the Comelec second division, saying he received the information 10 minutes ago, but did not provide additional details.

The Comelec division said Poe, who was leading in various pre-election surveys on presidentiables, became a resident only on July 2006 when she applied for dual citizenship, or two months short of meeting the 10-year residency rule.

The division also said Poe "deliberately attempted to mislead or misinform the electorate or hide a fact from them when she supplied the answer '10 yeras and 11 months' to the question" on her period of residence in the Philippines in her COC.

Meanwhile, Poe's lawyers insisted that she became a resident in May 2005, according to a report on "24 Oras."

Poe's camp said they will appeal the decision with the Comelec en banc.

Elamparo's petition was just one of the four petitions seeking to disqualify Poe from the presidential race.

      She needs at least 10 years of residency to qualify as a president. 7 years pa lang sya resident sa philippines.

  36. Being on TOP of the surveys doesn't guarantee that majority of Filipinos will vote for you. What has Grace done for the country anyway? MTRCB? Artista fame of her adopted father? She always insists in every speech that she will FINISH what her father started in 2004.

    Question is: What did your adopted father start in 2004? Running for the presidency? He was never an elective or appointive public official. He had no experience in government service.

    What could have been his contributions? We never heard him speak eloquently in discussing different national issues, policies and arguments.

    Lastly, Grace should stop using her father as an excuse to run for the presidency because there was never a BEGINNING in the first place. Grace misled the Filipino public in her citizenship and residency issues. Those are the real and legal issues.

  38. hindi nya kayang i-appeal ito sa supreme court after nya i-criticize yung 3 supreme court justices who voted not in her favor, after her disqualification case before the Senate electoral tribunal was denied. ngyon comelec na nag disqualify sa kanya. vindicated ang mga SC justices. kulang pa sya sa residency ang di pa nya na-prove na natural born citizen sya. Tama yung pinsan nyang si Sheryl Cruz, now is not the time for her to run. vindicated din sya.

Wala din syang pinag-kaiba nina Bong Revilla Jinggoy, o ang bug*k na si Tito Sotto na mga hindi dumaan sa lower level na govt positions. From artista to Senado! Kapaaaaal talaga. Ito naman si Poe humugot sa kasikatan ni Panday, nanalo out of sympathy votes. Walang hiya talaga.
