If this is so, why is she trying to run for president??

Elamparo. Yung 10 year RESIDENCY kasi ang usapan.

  5. But isn't by previously renouncing her Filipino citizenship, she lost her natural born status?
And coz of that di nya na meet ang 10 yr residency requirement?

Correct me if I'm wrong, guys.

    1. She might have dual citizenship which both the US and the Philippine allow. When she took her oath as a US citizen she lost her Filipino citizenship. But one can apply for Filipino citizenship take oath and be a citizen of both the US and the Philippines.

    2. There is a jurisprudence in Political Law regarding this. So let me please enlighten you a bit.

A natural born citizen who loses her Filipino citizenship by pledging allegiance to another country may reacquire citizenship by repatriation, naturalization or direct act of Congress. Technically in this case, a person, who WAS a natural born Filipino, is re-taking what was once his, unlike in the case of foreigners who wishes to become naturalized Filipinos.

By pledging allegiance to the Philippines, a person reacquires his being a Filipino. From that very moment/date of reacquisition of Filipino citizenship, the 10-year residency requirement can already be reckoned with. Corollary in this scenario is the fact that the person is a natural born Filipino citizen, otherwise, the benefit of reacquisition of citizenship does not apply to him.

In the case of Poe, she is a foundling. Her bloodline is unknown. For her to be able to establish her natural born citizenship, she must first prove that either her father or mother is a Filipino. This is a basic CONSTITUTIONAL provision that even the great lawyer Chiz seems to ignore intentionally. Absent that proof, she is not eligible to reacquire Filipino citizenship. Her oath of allegiance to the Philippines makes her a NATURALIZED born citizen only. Further, counting the period of Poe's residence is a futile exercise if she is not a natural born citizen. IN ALL HER DISQUALIFICATION CASES, as a lawyer, I humbly believe that she is, to begin with, barred to hold any elective office.

She chose to be American eh di sa America sya tumakbo!

      Delete
    4. You are right! Her residency info when she filed her candicacy mismo was the proof that she is not qualified because she lacks the 10 year residency.

      Delete
    5. She can't, she's not a natural born US citizen. She was not born there. You have to be born in the US or have US citizen parent if born somewhere else. Same problem.

  8. No offense pero kung iclaim nya na natural born sya for the sake na makakatakbo pero sa puso nya Amerikana pa rin sya nagiging oportunista lamang sya. Sana kung feel nya natural born Filipino sya sana tinangkilik nya un Philippine passport nya hindi un american passport

  10. Public's interest or your sole interest?

Hay!

  14. Dura Lex Sed Lex. The law may be harsh, but it is the law. How do you expect us to have a president na siya mismo, lumalabag sa batas.

    1. Korek! Simpleng pa fill up lang ng certificate if candidacy di mo pa magawa ng tama, at sinumpaan mo pa yun, magpre-presidente ka pa? Give it a rest at try to fix your citizenship and your family's before running for any position again.

  24. wait lang, sa senatorial race ba, lesser ng years of residency ang kelangan bago tumakbo? kasi why only now?

dapat nung last election pa sana di ba.. kinalkal na lang sguro ngaun kasi for presidency na..

At saka bakit mo igigive up ang citizenship mo?? Amerkana ka na nga ayaw mo pa

    ReplyDelete
  26. By saying "i hope the interest of the people will prevail in the decision of Comelec en banc" , she knows that technically she really is not qualified in terms of residency/citizenship for presidency

    ReplyDelete
  27. I guess blessing in disguise para sa kanya to. Maganda nga para di masyadong mapahiya. Stay in the senate and get more experience then in a few years time you should be ready for presidency.

    ReplyDelete

  29. "INTEREST OF THE PEOPLE"? Eh what about the Rule of Law, Madam?
