    3. Residency, as regards election, in accordance with our laws and jurisprudence is synonymous with domicile. Domicile=physical presence+animus rivertendi (intent to return)+animus manendi (intent to remain). In our equation, however, Sen. Poe lacks physical(bodily) presence 10 yrs immediately preceding the election. So, Atty. Fortun has a point. We cannot bend the Constitution for a momentary response to a momentary problem because it's the supreme law.

    3. Marcos case is different honey as she never lost domicile and she did not acquire US citizenship she was forced to be on exile. While Grace acquired US citizenship and only renounced it when she got a government position. What if she did not get a government position would she renounce it? She filed some documents that stated her year of residence which is a legal document. Why bend the law there will be more elections to come?

    4. 1:48 Grace never lost her Filipino citizenship. She acquired US citizenship by virtue of marriage to her US citizen husband but she remained a Filipino citizen thru the dual citizenship law. Besides, this is not a matter of citizenship but residency. And the SC is very clear, the declaration in the certificate of candidacy is not conclusive. If there are evidence to show that in fact you satisfy the residency requirement, then yung ang magma-matter. PLus animus revertendi is the rule. Plus, FACT is, she has been living here since here return when her father died. 2004 pa yun. Sobra na siyang 10 years.

No way in hell will a winning presidential candidate be disqualified.It will be chaotic, thus any disqualification will be settled prior to the election. Besides, as soon as ma-declare na nanalo, it will be the SEnate Electoral Tribunal who will handle it. They will not risk catching the ire of the voters of a winning president.

However, the law is clear that one of the qualifications of the President of the Philippines is that he/she should have resided in the Philippines for at least 10 years prior to the date of his election. That is what the Constitution, the highest law of the land, says. It must be followed. Otherwise, push for charter change.

    I really really really really like you, do you like me too?

    Our laws are slowly getting irrelevant, sometimes we have to bypass certain things for the greater good. Do you really think the length of residency is the measuring factor for one's patriotism? (Compared to those who have stayed in the country and his seat of power for his entire political life, and corrupted himself to his power and wealth). Please ponder upon it, I respect the law, but our country's in a critical point, and decades late from our neighbor country's progress.

If the citizens learn how to be disciplined etc... The Philippines has a long way to go. There are other politicians that have integrity and have a clean track record too that can make things happen. :)

Fortun na ayon sa constitution dapat yung magra-run ay may 10 years and above residency dito sa bansa because they know daw what ills this country and desire to be a catalyst of change... Eh bakit hanggang ngayon ganito pa din ang Pinas, palala lang ng palala... Wala naman nabago... Ganun pa din eh kung tutuusin lahat ng namuno eh dito na pinanganak at tumanda... Kaya I think di pa din batayan yung residency although nasa constitution kaya need talaga sundin....

  42. Yes he is right . That is the law. The law must be enforced. What's another 4 years anyway ? The law can not be bend over to accommodate a single persons political ambition. Stop personally attacking Atty Fortun just because he is educating the public. If you have any legit issues please feel free to file a complaint to the bar association . :) huwag magpahalata t at kayo ay nakakatawa;)

  44. masyado pang newbie si Grace Poe para maging president maybe next election nalang, itatake advatange yan ng mga gusto gumamit sa kanya syempre since new nga si Grace mas need niya yung mga tao mas alam pasikot sikot. if gusto niya talaga mg president iprove niya muna na worth it siya kung gusto at malinis talaga intention niya para sa bansa. pero kung ginagawa niya lang talaga yan para sa partido or sulsol ng iba then wala siya pinagkaiba sa ibang politiko.
