my job is incline with designing (although i dont design clothes)...And as far as i know, every design is the designer's INTELLECTUAL PROPERTY! Though paid, the sole right still belongs to the designer. Gets nyo? But that's only applicable to the design itself (intangible)... On the other side, the gown (tangible) is owned by the client already, so dapat jan humingi ng permiso yung designer na gagamitin nya yung GOWN kung saan... pero pag sinabing gumawa uli ng replica ng gown yung designer (with the exact design and details) walang problema kasi nga sa kanya yung design. I know the bride. The bride who owns the gown message the designer-friend pa naman nya (or ex-friend na ngayon). The designer friend said the production staff saw her gown nga and they asked the same design for maja. Anon8:00AM is right. The design/idea (intangible) is the designer's property, thus, she can not say it is her gown unless she is refering to the gown itself (tangible). How could have issue like this been avoided? The bride could have it stipulated in a contract that this design could not be used, which could make the the gown more expensive becuase it will now have exclusivity. Having paid a high price for the gown does not automatically translate to exclusivity, dear!
when you ask the designer to do a custom-made gown for you, the design IS part of what you pay for. pag nagpunta ka sa designer and di mo type yung design, you are even REQUIRED to return the sketch. The gown was used for a photo op. it's easy to just pin the gown para no need to adjust. just to clarify, the designer borrowed it for a fashion show. he didn't ask for permission to have the gown copied. She can say "My gown" kasi the design should be uniquely hers. If you had a photo of your face and I photocopied it either enlarged or reduced, then showed it to you. You'll still say "My photo!". according to a close friend of the designer, the gown is not 2++k, it was given on a discount, the price 90k. it wasnt pulled out and it was never been used for a fashion show because the designer didnt even participated in any wedding fashion show after diane's wedding. the designer texted the bride 4 times to pick up the gown and sadly she never came. the gown is now accumalating dust and cant be used anymore. Majas dress is different, even the fabric used is different.
Honestly, I don't think Diana can say anything about this since the idea belongs to the designer anyway. Maybe had she been informed beforehand that this was coming out, things wouldn't turn out this way.

Deletemy job is incline with designing (although i dont design clothes)...And as far as i know, every design is the designer's INTELLECTUAL PROPERTY! Though paid, the sole right still belongs to the designer. Gets nyo? But that's only applicable to the design itself (intangible)... On the other side, the gown (tangible) is owned by the client already, so dapat jan humingi ng permiso yung designer na gagamitin nya yung GOWN kung saan... pero pag sinabing gumawa uli ng replica ng gown yung designer (with the exact design and details) walang problema kasi nga sa kanya yung design. OKAY, BOW! =D
I know the bride. The bride who owns the gown message the designer-friend pa naman nya (or ex-friend na ngayon). The designer friend said the production staff saw her gown nga and they asked the same design for maja. Sa side ni bride, it's nakakainis nga naman because she paid a lot for that design tapos makikita nya yan without her knowledge. Nag-sorry naman si designer sa kanya pero too late na. It's not patented nga pero what the designer did is unethical esp since most brides paid a lot for their very own and uniquely designed gown for their wedding. Sayang ang friendship nila.

DeleteAnon8:00AM is right. The design/idea (intangible) is the designer's property, thus, she can not say it is her gown unless she is refering to the gown itself (tangible). How could have issue like this been avoided? The bride could have it stipulated in a contract that this design could not be used, which could make the the gown more expensive becuase it will now have exclusivity.

Ipinakita nya yong one dress similar sa sout ni maja. Aywan kolang kong same material at designer pero the style of the wedding gown na nakita ko ay may feather sya at yong sout ni maja parang my feather din yong style. Maybe nakita rin Ito ni Kim at ipinagawa nya sa atin. Kong sa kanya naman ang wedding dress na yan at ipinigamit nang walang paalam may karapatan syang magalit.

I have a client of a good wedding gown designer and her gown cost 110k. ang alam ko pag nisketch sayo yun gown na yun, yun design na yun sayo yun. kasi i never also did see any replica made for my gown of the same designer i booked before nun kasal ko. so as rule, maybe i dont know if me ganun rules ang mga designers na dapat di nauulit ang same na same design on different bride unless RTW sya. or pinagaya mo lang din from other bride. kaya siguro nag react si Ate. Ang tanong, e yun sinuot ni maja gown nya ba? as in yun na yun? kasi if replica nga, tama nga it should not be said na MY GOWN, dapat SAME AS MY GOWN.
ReplyDeleteIt's not a replica. It's the exact gown. The designer borrowed the gown last year. but he has not returned it. That's why it's right when she said "MY GOWN"

ReplyDeleteI know Diana personally and yes, she paid big bucks to have this gown made exclusively for her. And yes, that IS her EXACT wedding gown. John Herrera apparently borrowed the gown for a fashion show BUT never asked her permission to have Maja Salvador wear it for that TV series. This is not a personal attack on Ms. Salvador, so please relax your underpants!!

ReplyDeleteAng mali ni Original owner ng gown ay pinahiram niya. lesson learned: wag magpapahiram ng gown esp if your designer is sikat. kahit naman siguro ako maiinis ako makikita ko yung exacto gown ko sinuot ng iba without my consent... i have the right to get mad at mainis. gown ko yan eh!:D

Of course the original owner will rant in FB, it's her FB and it's social media. Where else can you talk about it and get friends opinions on unusual situations like this? This doesn't happen everyday. What the designer failed to do is realize that the wedding gown is a very personal thing to the owner. Not just his piece of work.

DeleteIts not maja's fault kung yan ang pinasuot sakanya ng stylist niya. Props lang naman yan. Sana bago ipahiram ni designer kay stylist nagpaalam muna sa may ari ng gown. Nabasa ka na magbibigay si designer ng free gown kay diana..........

Naiinis siya kasi exclusive ang design para saknya at binayaran ng mahal pero si designer gumawa ng isa para iparent. Petite si maja then si diana may laman kaya kung ipapasuot kay maja ang original gown maluwag. At kay diana hindi gaano kahaba ang buntot kay maja abot atah hanggang backstage
ReplyDeleteIt's not a replica. It's the exact gown. My friend is taller than Maja. During Diana's wedding, her heels were at least 5 inches. that's why it looks shorter on her compared to Maja. The gown was used for a photo op. it's easy to just pin the gown para no need to adjust. just to clarify, the designer borrowed it for a fashion show. he didn't ask for permission to have the gown copied. He also didn't ask for permission for the gown to be used in the teleserye. nakakainis nga kasi it's supposed to be exclusive. tapos biglang ganun.

DeleteShe can say "My gown" kasi the design should be uniquely hers. If you had a photo of your face and I photocopied it either enlarged or reduced, then showed it to you. You'll still say "My photo!". Do you have time to think and say "That's a copy of my original photo!"? So because she said it in a way that you don't understand, it does not mean her claim is any less significant.

Kung inspiration lang naman wag na siya magalit, pero exact gown? Nakakagalit talaga kasi yun ang isinuot mo sa special day mo tapos isusuot lang ng ibang babae, worse is di pinaalam sayo. Deleteaccording to a close friend of the designer, the gown is not 2++k, it was given on a discount, the price 90k. it wasnt pulled out and it was never been used for a fashion show because the designer didnt even participated in any wedding fashion show after diane's wedding. the designer texted the bride 4 times to pick up the gown and sadly she never came. the gown is now accumalating dust and cant be used anymore. Majas dress is different, even the fabric used is different.
ReplyDeleteHonestly, I don't think Diana can say anything about this since the idea belongs to the designer anyway. Maybe had she been informed beforehand that this was coming out, things wouldn't turn out this way.
