The Singer's Diva Manager

A few months ago, a mall's marketing manager booked this female singer for a show in his mall. Upon going through the singer's contract, he discovered an absurd clause that states that the client has to provide the artist with "Class A Food". In his years of booking celebrities, it was the first time that he had encountered such a clause in a contract. Based on his previous experiences, the mall's celebrity guest is always given the best possible treatment even without being told. It has been the mall's practice that when a celebrity is still waiting for his/her turn to go on stage, he/she is invited to a nearby cafe or restaurant and is served with anything that he/she wants to order. It is common sense that the guest artist is never given lunch boxes just like the rest of the production crew.

On the day of the show, it started to rain cats and dogs. The heavy rain made the marketing manager decide to cancel the show that was supposed to take place in an open area. Upon making this decision, he immediately rang the manager of this singer informing him not to proceed to the mall anymore. When the manager heard this, he started yelling at the marketing manager and insisted that he should still pay for the singer's talent fee.

It has always been a practice of this mall to just reschedule a celebrity's performance in the event of a show cancellation due to acts of God. This was the very first time that the he had to pay an artist in spite of her inability to perform because of a fortuitous event. After this untoward incident, the marketing manager has vowed that he will never ever deal with the diva manager of this singer. It is just too bad for them because this marketing manager is in charge of several malls all over the city.

  6. ai...meron dn ako alam na kwentong ganyan...pro banda naman sila...anniversary ng isang university sa manila tapus alumni ata sila dun...gusto ng banda na may sarili silang dressing room na hiwalay sa ibang artists tapus gusto nila catered ung food...e fund raising ung ginagawa ng university ska hnd naman tlga sila sikat nung time na un...mas sikat pa sila dati para umarte sila ng ganun...and mas sikat pa ung ibang banda na hnd naman nagiinarte...and dahil nga wlang budget ung university (although, meron tlga kac nga fund raising un kaya they dont expect to spend much) hnd nila kinuha ung band...hehehehe! may mga artists plang ganun...so sad nmn...kaya cguro hnd na sila sumikat kasi wla nang gusto kumuha sakanla...

  8. I honestly think there's nothing wrong na maglagay ng 'rules' ang isang artist sa mga contracts nya. For their protection naman yun. 'Di ba nga sa US grabe ultimo color ng couch and kilos ng mga tao around may nakalagay? Kung kaya nila ibigay yung demands ng foreign artist bakit hindi sa local? And yung clause naman for 'class A food' is for everybody who hires her not just for that mall who always provided her with good food. Sila ganun, what about yung iba? To make things easier malamang may standard contract na sya talaga and hindi gumagawa ng bago for every show. And yung payment, dapat talaga may bayad even if you cancel. Kasi nga may contract. Kasi trabaho 'to and kung in demand ang singer pwedeng na-book sya ng iba for that day and kumita. Unfair naman 'di ba? Kung it has always been the practice of this mall to reschedule..is this a promise by words lang or written sa contract? Then resched yung concert but not the payment. What if abutin ng 10 years ang management bago mag resched? Or tamarin na mag resched. Again protection yun for the singer na matutuloy pa din since bayad na sila. Since nacancel na to it means natuloy yung pagpirma nila sa contract that includes yung 'class A food' clause bakit nirereklamo pa?

  9. Eto ba yung artistang nagpapaalis ng kapwa niya artista pag ayaw niyang kasabay sa production under this famous Sunday variety show? and the manager shares the same name as the most eligible bachelor na host ng rival network's noontime show? or i may be wrong. haha

  10. I totally agree with june 19@10:40am. Equal rights - foreign or local. Kasalanan ba ng singer na umulan at i-cancel sya? Eh di sana nakapag-work sya sa iba kung di sya bi-nook ng mall. It's not easy to re-schedule lalo na kung masikip ang sked.

If the show is postponed due to bad weather, the standard contract states that it is automatically rescheduled to a date not later than 30 days from original sked, mutually agreed upon between both parties. If it gets cancelled AGAIN for the same reason, then it is force majeure and talent has to collect full pay, without question. That's a simple standard contract we have with mall shows.
    Contract also calls for private holding area, comfortable dressing room, potable water and meals for artist and one companion. PLUS, normally, as a performer, you don't even feel like eating before going up on stage. Haha. Pa-efek nga ito'ng germany na ito!

  18. i think dapat lang talaga bayaran yung singer, especially the cancellation happened just a few hours before the actual event. opportunity loss yun sa singer e. kung siguro days before the event yung cancellation, mas maiintindihan ko na i-request ng mall marketing manager na i-waive na yung talent fee.

    me thinks, power-tripper din ng konti si mall marketing manager, he thought he can get away with it porke't madami sya hawak na malls.

I once read here in the net the contract of Beyonce, Mariah, Celine Dion and J Lo...nakakawindang ang demands pero kung i-analyze mo okay lang naman, example, requirement ni JLo ang white flowers in the room, kay Mariah ang 25 deg cold water, ky Celine ang anti microbial hand rub or sumthing...in other words, kontrata e, so sundin dapat. Sure ako kaya nagsusumigaw ang manager kasi siguro parang ayaw i-honor ng mall yung kontrata...

    agree.. its like making a reservation... you make a down payement and etc.. yung iba may cancellation fee pa. as for the singer.. don't judge her kasi the blog is about her manager.

  29. Kung si bossa nova yan, naku, balita namin nagpapapresyo yan lagi. She was offered once to pose for a cover for a magazine. Humingi ng TF. Eh, yung ibang big stars nga daw hindi humingi ng TF, si starlet bossa nova pa. Di na nga uso ngayon ang music nya eh.

  34. I don't really fault the singer for indicating she wants "Class A" food, I don't think that's unreasonable. It's not like she was stipulating a specific dish or a rare delicacy or a particular brand/restaurant. My guess is that she had this stipulation because she had a bad experience with food that was provided to her in an event before, so she felt the need to have that stipulation.

    As to the demand for payment, while the manager shouldn't have yelled at the marketing manager, my guess is that as per contract, she was right to demand it. If she wasn't entitled to it, why would the mall manager pay? If I were the mall manager, and I know that contract stipulates that I am entitled to reschedule the appearance and am not obligated to pay her for the canceled one, why would I pay up? If the law was on my side, then why would I give in to the diva manager?

    I'm not really on the singer's side (I find her songs terribly annoying) but I just really find it strange that they paid the singer if she didn't have the right to be paid as per the contract.

  36. I have no idea who this is pero I think these are the important points from the BI:




    1. Manager is rude and crass - who the hell writes up a contract with "Class A food"? Jejemon much? Dapat ung clause is worded carefully such as "food appropriate for the talent's status". Class A, ano un grade ng rice grain? Second, he starts screaming at the marketing manager over the phone. You can insist that the talent be paid even if the show was deferred - irereschedule right, not outright cancellation per practice - without resorting palenkera mode.




    2. It appears that the terms of the contract may include a provision that in case of force majeure, the talent might not be paid the full fee outright in lieu of the show being rescheduled. Otherwise the manager would not be screaming mad over the phone that the talent should be paid. Kasi kung asa contract na in case of force majeure, the talent gets paid the full amount regardless if the show is rescheduled and should the show be rescheduled, that would correspond to another fee then wala itong blind item na to. It's implied sa article na what the manager is insisting on is unreasonable because wala sa contract.




    I have no idea who the talent is pero it appears that the point of the article is to illustrate the crassness and lack of "Class A" ni talent manager. Clues naman sino si talent and TM hehe

    Ang tanong ilang hours before ng show nag cancel si mall rep para uminit ang ulo ni manager. Hindi kaya andun na sila etc.

    Regarding naman sa pagpepresyo ng mga artist. Alam nyo naman mahirap ang pera ngayon. Tamo si Actress A napilitan bumalik sa other channel para mas regular ang trabaho. Syempre hanggang sa kahuli hulihang kusing na pwede mo mademand take mo =)

  46. If mall manager knew the details of contract he would have been more prepared to bring the issue to diva talent manager and have managed the situation better.

    If he thought that Spec of 'Class A Food' was too hoity toity for his standards, eh di red flag na sana yun that he has a queen to deal with.

    He ended up paying the artist na lang because rescheduling was a moot point. Then, cancelled the rest of the bookings so he won't have to deal with the talent manager forever. Luz Valdez si mall manager ng isang show. Was it worth it? I think so, marami namang talent diyan sa tabi tabi.

    Next time, mall manager, part of the job is crisis management pre-show, and not sour graping post-show.

  47. It is unfair for the mall to expect the singer not to be compensated just because they cancelled the affair for whatever reason. I think that the singer should be paid at least 75% of her TF to compensate for the loss of income that day. Hindi naman sya ang nag-cancel eh, so why would she be made to suffer the consequences of the mall management's decision?
    Whatever she stipulates for in the contract (whether class A or a particular fast food meal), is the beside the point, the client accepted her terms so , so they don't have to bitch about it just because she put her foot down about not being paid. If they don't accept any of the terms the artist wants, nego na agad prior to the show. Hindi yung gagawing issue to cover up their own pang-aabuso.
    In other words, kinuha nyo, bayaran nyo. Sinabi nung kabila kung ano ang terms nya, pumayag kayo, so bakit kayo magrrereklamo? Ang puno't dulo lang naman nito ay, ayaw nyong magbayad.

  48. well, ate, that's fair naman, na magdemand ang manager ng abayd kc nasayng din naamn ang kita kong may naka sked sya sa iba dba?.. fair lng yun, kung ano pa mana ang amnyari, matuloy man o ndi dpat abyaran kc nga naka sekd sya dun, kung ndi sya nag oo dun, edi may extra income sya sa iba.

  49. Bakit tayo ganyan, OA tayo mag-react pag ang local artist ang nagdedemand ng kung ano-ano sa kontrata. Simple lang naman yan, don't get the artist if you think the demand is unacceptable. What you are doing is simply not fair. You expect the artist to do what you want of her but you cannot be expected to do the same. Who is unprofessional here?

    Another thing, it is only fair that the artist should be compensated despite the cancellation. Imagine naman the lost income when she accepted your contract. Nasa contract naman siguro yun, siguro you were just too lazy to read the fine prints.

    Ang mga Pinoys pag me nabasang ganito, pansin ko lang, ang bilis mag-judge pero ang hina sa analysis. Why do you think me mga artista na tayong nagdedemand ng ganito - dahil ba sa maarte sila or madalas, they are being taken for a ride by these greedy businessmen.

  51. ang mali dito yung attitude ng manager, which is the main issue sa article na ito. tama lang naman na ma-compensate ang artist dahil day of the scheduled concert na nag-cancel ang mall manager, unfair rin sa artist yon.
    and whatever is stated in the contract, no matter how far fetched or absurd, contract pa rin yon, take it or leave it, ganun lang yon.
    so it's the manager who is the "walang modo" in this story.

  52. i just want to defend Artist S. she was a classmate of mine in one subject way back in college. she was really nice at walang arte sa katawan. she even greets me every time kahit sa labas ng class because she knew i watched the MTV competition, and classmate ng sister ko yung isa pang UP student na contestant din sa same show so we'd always have small chat about that.


    3 years after college, there was this album signing sa isang Kahong MalL. i was with my husband, our baby, and a friend. we got curious kung sino ang featured artist, and when we got to see who it was, natuwa yung friend namin kasi he likes her daw and he asked us if we can wait for him because we wanted to take her picture. I told our friend,"ah si S...classmate ko yan eh." siguro dahil sa magkakalapit yung mga tao, two girls who were just behind me heard what i said. they mocked me saying, "Ay classmate daw! eh di ano na ako? Bodyguard?" sabay tawa nang malakas. It pissed me off big time, so I tried my luck and offered my friend to take S's picture for him. since i'm petite i easily squeezed myself into the crowd and in no time i was right at the front of the stage. ang guess what? when S looked up after signing an album, her eyes caught me just below the table (syempre nasa itaas yung stage at nasa baba nya ko) at walang isip-isip she shouted,"Oi classmate! How are you na?" For sure the two girls heard it and pahiya sila. Hehehe...

    My point is, if she's just a user, as soem people here say, would she have really remembered me? We were just classmates in only one subject and we were not even in the same student organization. So, i guess she really just appreciated the support i gave her back then, kahit na I nver told her i liked her, or even my sister's classmate for that matter, and those kinds of "pambobola" stuff. I simply told her i always watched that MTV show (because I'd really watch it with or without her there). But still, she remembered me, even after 3 years!

    So there. I just wanted to state my case kasi I really felt bad reading others here calling her names.
